DA: Officer Was Justified in Opening Fire After Being Struck by SUV Driver

PLYMOUTH TWP., Pa. — The Montgomery County District Attorney’s Office says a Plymouth Township police officer acted lawfully when he fired his weapon at the driver of an SUV who struck and seriously injured him during an encounter last month.

According to the DA’s Office, the incident unfolded around 12:30 p.m. on Friday, October 24, when the officer responded to the DoubleTree Guest Suites Hotel on Fountain Road for a report involving a suspicious vehicle.

Investigators say the officer was searching for an SUV that had been linked to multiple incidents across Montgomery County and surrounding areas. When the officer located the vehicle in the hotel’s parking area, officials say the driver suddenly accelerated, striking the officer with the SUV.

The impact caused serious injuries to the officer, according to the DA’s statement. As the vehicle continued forward, the officer discharged his firearm at the driver in what investigators determined was a lawful use of force.

The DA’s review concluded that the officer was in immediate danger of death or serious bodily harm, and firing at the vehicle was a justified response under Pennsylvania law.

The SUV fled the scene following the impact. Additional details about the driver, potential charges, and the broader investigation into the earlier incidents involving the SUV were not immediately released.

The injured officer is recovering, officials said. No additional injuries were reported.

The investigation remains ongoing.
