Pennsylvania’s new vape law could pull many e-cigarettes from store shelves Oct. 19

HARRISBURG, Pa. — Pennsylvania is preparing to enforce a new law that will restrict which e-cigarettes and vaping products can be sold in the state.

Act 57 of 2025 requires nicotine e-cigarettes to be listed in a directory maintained by the Pennsylvania Office of Attorney General before they can be sold for retail in the Commonwealth. Products that are not listed may be seized beginning Oct. 19. 

The law is not a blanket ban on vaping. It targets the sale of products that are not included in the state directory. The requirements cover nicotine e-cigarettes, including certain components and parts sold separately for use with those products. 

As of Oct. 9, the Attorney General’s online directory showed no approved products. The office said 22 manufacturer certifications were under review and that the directory would be updated as products are approved. The enforcement date remains Oct. 19. 

That leaves retailers facing uncertainty about what products they will be able to sell once enforcement begins. In an Oct. 2 report, CBS Pittsburgh described concerns from vape shop owners who said the limited number of products appearing on the approved list could mean removing much of their inventory. 

Under the law, retailers, wholesalers and importers could face civil penalties for offering unlisted products for sale. The Attorney General’s guidance says a first violation can result in a $500 penalty for each product offered for sale. Penalties can increase for repeat violations and may include suspension or revocation of a retailer’s license. Unlisted products may also be seized, with businesses responsible for related costs. 

Act 57 was signed into law in December 2025. Manufacturers seeking to keep their products on the directory must submit annual certifications, according to the Attorney General’s office.
